New Delhi: GOI vs opposition legal battles come in different shades — but mostly with one common feature. Senior advocate Abhishek Manu Singhvi is the lawyer of choice for opposition parties and their leaders.


To take headline-making examples, Singhvi, who is a senior Congress spokesperson and an ex-MP, has represented AAP’s Delhi govt and Delhi CM Arvind Kejriwal, Sharad Pawar and his NCP, and Mamata Banerjee’s govt and TMC leaders — all in Supreme Court.


Singhvi was the lawyer who successfully got Kejriwal interim bail. He convinced the SC bench that Kejriwal’s was a fit case for interim relief. Delhi high court had turned down Kejriwal’s plea challenging his arrest. AAP’s chief campaigner was running short of time. Delhi’s voting day is May 25.


That the CM didn’t respond to nine summonses by ED was an argument for the prosecution. But Singhvi and his legal team focused on the timing of the CM’s arrest and time gap between ED registering the case and the arrest. That argument proved pivotal.


Singhvi’s broader strategy was to put the burden of justifying the arrest on ED. Had he argued for bail, the onus would have been on Kejriwal’s counsel to show he deserved bail. Instead, he challenged ED’s arrest. That put the onus on ED’s counsel to convince the court that Kejriwal’s was a valid arrest.


Singhvi had also ap- peared for Sanjay Singh when SC granted bail to the latter. He has been representing AAP govt in its numerous legal battles against the Centre. The senior lawyer came to the rescue of AAP govt when the apex court threatened to attach its advertisement funds for not giving its agreed share of money for the Delhi-Meerut Regional Rapid Transit System.


Singhvi, people who have followed his career say, is the lawyer’s version of an all- rounder. Criminal matter, constitutional law, administrative law, corporate law or commercial law — he has argued tough cases across the board. He’s one of the most sought-after lawyers.


Singhvi appeared for Pawar in his legal battle with his nephew Ajit. Post-NCP split, Pawar Senior’s faction didn’t get favourable rulings from EC, which recognised Ajit’s faction as the ‘real’ NCP and granted it the party symbol of ‘clock’. 


Singhvi convinced the apex court to direct EC that Pawar Senior’s faction be recognised as ‘NCPSharadchandra Pawar’.


Ajit and his faction were also barred from using the name and picture of Sharad Pawar to attract voters during elections and were asked to mention in all their advertisements and pamphlets that the issue of ‘clock’ symbol was sub judice. 
Mamata Banerjee’s govt and many TMC leaders are at the receiving end in various cases, and the Bengal govt has been at loggerheads with the Centre. Singhvi has been the go-to counsel for TMC.
