Prayagraj : Poker and rummy (card games) are games of skill and not gambling, the Allahabad HC has ruled, and directed Agra police commissionerate to revisit its order denying permission or licence for the “recreational activity”, reports Rajesh Kumar Pandey. The petitioner, Dm Gaming Pvt Ltd, had moved the HC against a Jan 24 order by the Agra police commissionerate DCP, rejecting its application for a licence to run a gaming unit, where games such as poker and rummy would be played.


Disposing of the writ petition, a division bench comprising justices Shekhar B Saraf and Manjive Shukla, observed: “Denial of the permission only on the basis of the clairvoyance of the officer concerned cannot be a ground that can be sustained. Hard facts are required to be brought on record by the officer to deny the permission for carrying out the recreational gaming activities.”
 The bench also directed the authority concerned to study the judgments of the Supreme Court and various high courts on the issue.
