The Punjab and Haryana high court has made it clear that any person cannot be held to be in illegal or unlawful detention if they have been kept in quarantine by the authorities due to the Covid-19 pandemic, reports Ajay Sura.

Justice Lalit Batra also clarified that the habeas corpus petition for the release of such persons is not maintainable while dismissing a petition filed by two residents of Assam and Bihar who were kept in quarantine/isolation by Haryana health authorities.

“Basic steps initiated by the Government of India and the state governments to curb the impact of Covid-19 are meant for service to the humanity and such petitioners, have been rightly kept in a quarantine centre,” observed Justice Batra. The petitioners had attended the Tablighi Jamaat event in Delhi and were kept in quarantine. Aggrieved by the confinement, the duo approached the HC seeking “release from illegal detention by the Haryana government”.
