Saunders-Chanan Singh Memorial Fund

Chandigarh: The Punjab and Haryana HC has issued notice to Haryana government on a plea seeking amendment in the Punjab police rules (applicable to Haryana) allowing a welfare fund in the name of British police officer J P Saunders and head constable Chanan Singh, whom Bhagat Singh and other revolutionaries had shot dead. Both were killed in Lahore to avenge the killing of Lala Lajpat Rai. The then police authorities had set up the welfare fund to honour the British officer and head constable.


The main legal issue raised by the petitioner, a student of LLB, is whether retaining of the provisions of Rule 14. 29 of the Punjab Police Rules, 1934, that too after the 75 years of Independence is unconstitutional and violative of Article 19 (1) (a) of the Constitution of India. The Punjab government has already renamed the memorial fund after Late DIG Avtar Singh Atwal of Punjab police in 2003. However, Haryana (on which the Punjab police rules are applicable) has been still retaining the provisions of the Rule 14. 29 of the Punjab Police Rules, 1934.

A division bench, com- prising Justice G S Sandhawalia and Justice Vikas Suri of the HC, has issued the notice after taking cognisance of the petition. The Saunders-Chanan Singh Memorial Fund is meant to provide scholarships for the education of the kin of police officers who die or are killed while in service leaving their families destitute. The petitioner said, “The sentiments of the citizens including the petitioner with patriotic and nationalistic feelings are hurt by such provisions, as such the provisions deserve not only to be declared unconstitutional but also removed from the government published Punjab Police Rules as applicable to the state of Haryana. ”
