Right to free movement, peaceful protest not absolute: HC

Madurai : Right to free movement and peaceful protest, though guaranteed under the Constitution, are subject to reasonable restrictions, Madras HC held.
While hearing a case filed by a serial protester known for his unconventional and controversial protests, Justice B Pugalendhi said, “The right to movement and protest is not absolute. Citizens are equally bound by their fundamental duties.” The petitioner must obtain permission and conduct protests in accordance with law, he noted.
The petitioner, P Ayyakannu, state president of National South Indian River Interlinking Agriculturist Association, wanted HC to forbid central and state govts from int erfering with his free movement during his travel to Delhi with association members.
Trichy city police commissioner told HC the petitioner had instigated his associates by using masks of the PM’s face; observed fasts involving senior citizens, thereby endangering their lives; and participated in meetings halfnaked, causing public nuisance. As many as 73 cases have been filed against Ayyakannu, the commissioner said.
