Sedition case

2017: Vaiko surrenders

Vaiko surrenders in sedition case, held, April 4, 2017: The Times of India

In a bid to put pressure on the police and courts to start trial in a sedition case pending against him since 2009, MDMK general secretary Vaiko surrendered before a magistrate's court in Chennai on Monday and refused to apply for bail. This left the magistrate with no option but to remand him in judicial custody for a fortnight.

The case relates to the release of Vaiko's book `Naan Kutram Sattugiren' (I Am Ac Kutram Sattugiren' (I Am Accusing You), a compilation of the MDMK leader's letters to the then prime minister Manmohan Singh in 2009. The book was released in 2009 at a function in Rani Seethai Hall on Anna Salai in Chennai.

The Thousand Lights police registered a case against him for a “seditious“ speech punishable under IPC Section 124(A). Police completed their investigation, and filed a chargesheet in 2010. Since then there has been no sign of a trial taking place in the case.

Though a magistrate court's role is limited to committing the matter to a sessions court for trial, the judiciary has not completed even that process.

Vaiko appeared before the XIII metropolitan magistrate Gopinath and offered to file a petition to surrender. The magistrate offered to release Vaiko on bail. But the MDMK leader turned down the offer and did not file a bail application. This left the magistrate with little choice but to send the MDMK leader to judicial custody .

Vaiko resorted to Monday's action because courts and police showed no urgency in starting the trial, MDMK spokesperson and advocate Nanmaran said. Despite repeated attempts from Vaiko's side, the prosecution made no effort to proceed with trial, he said.

Tamil Nadu politician Vaiko was denied entry at the Kuala Lumpur International Airport on Friday morning as his name was on the “dangerous persons list“. MDMK chief Vaiko had flown to Malaysia to attend the wedding reception of Penang deputy chief minister P Ramasamy's daughter.

Vaiko was informed by officials that he would not be allowed into Malaysia because of his “LTTE connections“.Vaiko was told there were “several cases against him in Sri Lanka“. Vaiko informed Ramasamy about the episode, and Ramasamy contacted Penang chief minister Lim Guan Eng. “Officials told Ramasamy they had received orders from the Malaysian deputy PM's office,“ said an MDMK release.
